Brady/Giglio Compliance
Automated exculpatory evidence flagging, Giglio impeachment material identification, and disclosure checklists for Brady v. Maryland compliance.
Brady/Giglio Compliance#
Under Brady v. Maryland (1963), the prosecution is required to disclose all material evidence favorable to the defense. Under Giglio v. United States (1972), this obligation extends to impeachment evidence affecting witness credibility. FrameCounsel automates the identification of potential Brady and Giglio material within your video evidence.
Brady v. Maryland Overview#
Brady material encompasses any evidence that is favorable to the accused and material to guilt or punishment. In the context of video evidence, this includes:
- Footage showing the defendant did not commit the alleged act
- Video contradicting officer testimony about the sequence of events
- Recordings of statements by witnesses that differ from their written reports
- Evidence of alternative suspects captured on camera
- Body camera gaps during critical moments that undermine the prosecution's narrative
Materiality Standard
Evidence is material under Brady if there is a reasonable probability that disclosure would have changed the outcome. FrameCounsel flags potential Brady material but the determination of materiality is a legal judgment that must be made by the attorney.
Automated Exculpatory Evidence Flagging#
FrameCounsel's analysis engine automatically scans your evidence for potential exculpatory content. The system flags:
- Contradictions between police reports and video evidence (from the Report Comparison module)
- Timeline gaps where body cameras were deactivated during the encounter
- Exculpatory statements detected in transcripts that support the defense theory
- Use-of-force discrepancies where the level of force depicted differs from what was reported
- Witness inconsistencies where different witnesses describe the same event differently on camera
Each flag includes the specific evidence, a citation to the source, and a category tag for organizing disclosure materials.
Giglio Impeachment Material#
Giglio material relates specifically to witness credibility. FrameCounsel identifies potential impeachment material by analyzing:
- Prior inconsistent statements by the same officer across different cases (when multiple cases are loaded)
- Differences between an officer's testimony in reports and their actions on video
- Demeanor evidence where an officer's recorded behavior contradicts claims of threat perception
- Timing evidence showing improbable sequences in the prosecution narrative
Cross-Case Analysis
To identify patterns of officer misconduct or repeated inconsistencies, you can load evidence from multiple cases involving the same officer. Exercise caution with this capability and ensure compliance with your jurisdiction's rules regarding impeachment evidence.
Disclosure Checklists#
FrameCounsel generates structured disclosure checklists to track Brady/Giglio compliance:
- Automatically compiled list of all flagged exculpatory and impeachment material
- Status tracking for each item (identified, reviewed, disclosed, disputed)
- Date stamps for when each item was identified and when disclosure was made
- Export as PDF or DOCX for filing with the court
Access the disclosure checklist from Tools > Brady/Giglio Checklist or press .
